1. Acceptance of Terms
By accessing and using TaxAppealCenter.com (the "Site"), you accept and agree to be bound by the terms and provision of this agreement. The Site is owned and operated by Atlas Systems Group LLC (doing business as Tax Appeal Center). If you do not agree to abide by these terms, please do not use this Site.
2. Description of Service
Tax Appeal Center provides an automated data analysis tool that generates a PDF "Evidence Packet" for property tax protests (the "Service").
Crucial Disclaimer: We are a data aggregation software service. We are NOT a law firm, a registered property tax consultant, or a valuation appraisal firm. We do not represent you in hearings, we do not file documents on your behalf, and we do not provide legal or tax advice. You are representing yourself ("Pro Se") using data we provide.
Service Availability: We do not guarantee uninterrupted access to the Site or Service and may modify, suspend, or discontinue features from time to time due to maintenance, third-party API outages, or other factors.
3. No Guarantee of Results
By using this Service, you acknowledge and agree that:
- No Outcome Guaranteed: Tax Appeal Center does not guarantee that your property tax assessment will be reduced. The final decision rests entirely with your County Appraisal District (CAD) and Appraisal Review Board (ARB).
- Data Accuracy: We rely on third-party public data sources (County Records, Real Estate APIs). While we strive for accuracy, public records often contain errors (e.g., incorrect square footage recorded by the county). We are not responsible for errors inherent in the public record.
- Estimations Only: Any "Potential Savings" or "Fair Value" figures shown on the Site are estimates based on mathematical algorithms and comparable property analysis. They are not official appraisals.
4. User Responsibilities (Deadlines)
You acknowledge that you are solely responsible for:
- Filing on Time: Filing your Notice of Protest by the statutory deadline (typically May 15th in Texas, or 30 days after receiving your notice). We do not file this for you.
- Submission: Uploading or mailing the Evidence Packet we provide to the appropriate Appraisal District.
- Attendance: Attending your informal or formal hearing (if required).
We accept no liability if you miss a deadline or fail to follow your County's specific filing procedures.
5. Payments, Refunds, and Subscriptions
5.1 One-Time Purchases (Evidence Packet)
- Payment: You agree to pay the fee shown at checkout (e.g., $99) for the generation of the PDF Packet.
- Refund Policy: Due to the digital nature of the product, all sales are final once the Evidence Packet is generated and delivered, except as described below.
- Conditional Refund: We offer a refund strictly in cases of Data Failure. If our data is fundamentally flawed (e.g., we used the wrong square footage for your home vs. official records), we will issue a full refund upon review. We do not issue refunds simply because the County denied your protest.
5.2 Annual Monitoring Subscription
- The Service: If you select the "Annual Monitoring" add-on ($29/year), we will monitor your property assessment and notify you in future tax years if data suggests a protest is warranted.
- Auto-Renewal: Your subscription will automatically renew annually. You authorize us to charge your payment method on file.
- Cancellation: You may cancel at any time through the Manage Subscription page on the Site or by contacting support@taxappealcenter.com. If you cancel, you will not be charged for the following year.
6. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Atlas Systems Group LLC, its affiliates, officers, directors, or employees be liable for any indirect, punitive, incidental, special, or consequential damages arising out of your use of the Service.
Maximum Liability: In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid to us (e.g., $99.00 or $128.00).
7. Indemnification
You agree to defend, indemnify, and hold harmless Atlas Systems Group LLC from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) your submission of false or misleading information to a government entity using our data.
8. Intellectual Property
The content, algorithms, and design of the Evidence Packet and Website are the proprietary property of Atlas Systems Group LLC. You are granted a limited license to use the PDF Packet for your personal property tax protest. You may not resell, redistribute, or reproduce the Packet for commercial purposes.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Massachusetts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
